Debt collection procedure in Poland, step by step
Debt collection in Poland usually runs in two stages: amicable collection and, only if needed, court proceedings with enforcement. Here is what happens at each step.
1. Debtor analysis
We check the debtor in Polish public registers, its legal status, representatives, insolvency proceedings and payment history. Based on this we assess the chances of recovery. The analysis is free of charge.
2. Amicable collection
We send a formal demand for payment in Polish and contact the debtor by phone and e-mail. Our goal is payment or a written settlement with an instalment plan.
3. Sanctions and field visit
If the debtor does not cooperate, we use additional pressure: an entry in a business information bureau (BIG), publication on a debt exchange and a visit by our field collector to the company's office.
4. Court proceedings
With your consent we take the case to the competent Polish court. For invoice claims the court usually issues a payment order. If the debtor objects, the case is heard in ordinary proceedings.
5. Enforcement
A final decision with an enforceability clause is an enforceable title. On its basis a Polish court bailiff can seize the debtor's bank accounts, receivables and other assets.
Frequently asked questions
How long does debt collection in Poland take?
The amicable stage often takes a few weeks. Court proceedings and enforcement take longer and depend on the court, the debtor's reaction and its assets.
Do you go to court without my approval?
No. We take a case to court only with the client's consent, after presenting the costs, the chances and our recommendation.
